Terms of Service

These Terms are an agreement between Flotto(“Flotto”, “we”, “us”) and you, the person or business using the Service. By creating an account or using the Service you accept them. If you do not accept them, do not use the Service.

Service” means the Flottoplatform, including flotto.co, the application and the pages published through it. “Your Content” means anything you upload, generate or publish using it. “Lead Data” means information submitted by someone through a page you publish.

1. The Service

We grant you a non-exclusive, non-transferable right to use the Service for the term of your subscription. The Service lets you create, host and publish lead-capture pages, generate tracked links, collect Lead Data, and send it to an email platform you connect.

We may change or discontinue features. Where a change materially reduces what your plan includes, we will give you at least 30 days’ notice by email. We do not guarantee the Service will be uninterrupted or error-free.

2. Your account

You must be 18 or over and able to enter a contract. You must give accurate registration details and verify your email address before publishing. You are responsible for everything done under your account and for keeping your credentials secure. Tell us at hello@flotto.co if you believe your account has been accessed by someone else.

3. Your Content

Your Content and Lead Data remain yours. You grant us the permissions needed to host, store and display them in order to run the Service, and nothing beyond that.

You confirm you have the rights to everything you publish, and that it does not infringe anyone else’s. You are responsible for complying with the laws that apply to your collection and use of Lead Data, including data protection and marketing law.

4. Acceptable use

4.1The Service publishes pages that collect personal information from the public. You must not use it to:

4.2We screen pages automatically before publication and may refuse, unpublish or remove content we reasonably believe breaches this section. Where a breach is clear we may suspend or close the account immediately and without notice.

5. Email

A page may send one message to someone in direct response to their own submission. The Service does not provide newsletters, broadcasts or automated sequences. Any further marketing you send is your responsibility, including consent and unsubscribe requirements.

6. Payment

6.1Paid plans are billed in advance, monthly or yearly. Subscriptions renew automatically until cancelled.

6.2Payments are processed by Paddle, which acts as merchant of record and reseller. Paddle handles payment, invoicing, and any sales tax, VAT or GST. Your purchase is also subject to Paddle’s buyer terms, and charges appear on your statement as Paddle.

6.3Prices exclude tax unless stated; the total is shown before you pay. If a payment fails we may retry it and may suspend the plan until it settles. We may change prices on 30 days’ notice, taking effect at your next renewal.

6.4Cancellation and refunds are covered by our Refund & Cancellation Policy, which forms part of these Terms.

7. Trials and plan limits

A plan may start with a free trial. Unless you cancel before it ends, the plan begins and becomes payable; we will email you before that happens.

Each plan includes published limits. Publishing beyond your live-page allowance is refused until you upgrade or unpublish. Submissions from your visitors are never rejected for exceeding an allowance, though access to records above it may require an upgrade.

8. Intellectual property

The Service, its software and its trade marks remain ours. You may not copy, reverse engineer or create derivative works from it, except where law permits. If you send us feedback, we may use it freely.

9. Term and termination

9.1You may cancel at any time from the billing portal. Cancellation takes effect at the end of the period you have paid for, and you keep access until then.

9.2We may end this agreement on 30 days’ notice, or immediately if you materially breach it and do not fix the breach within 14 days of being asked.

9.3When access ends, published pages stop serving and tracked links stop resolving. You should export your data before that point; export is available at any time from within the Service.

10. Liability

10.1Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything that cannot lawfully be limited.

10.2Otherwise, the Service is provided as it is. We give no warranties beyond providing it with reasonable skill and care, and we do not promise any particular number of leads, deliverability or conversion rate.

10.3Neither party is liable for lost profits, lost revenue, lost data or indirect losses. Our total liability is limited to what you paid us in the 12 months before the claim.

10.4You will cover us for claims arising from Your Content, from your breach of section 4, or from your breach of laws applying to Lead Data.

11. Data protection

Personal data about you is covered by our Privacy Policy. Where we hold Lead Data on your behalf, you are the controller and we are the processor; that is governed by our Data Processing Agreement, which forms part of these Terms.

12. General

We may amend these Terms, giving at least 30 days’ notice of material changes; continuing to use the Service afterwards means you accept them. Neither party is liable for delays caused by events outside its reasonable control. You may not transfer this agreement without our consent; we may transfer it as part of a sale of the business. If any part is unenforceable, the rest continues. Not enforcing a term is not a waiver of it. These Terms, with the Privacy Policy, Refund & Cancellation Policy and Data Processing Agreement, are the entire agreement between us. 13. Governing law

These Terms are governed by the laws of India, and the courts at New Delhi, India have exclusive jurisdiction. A consumer resident in the UK or EEA keeps the mandatory protections of their home country and may bring proceedings there where the law allows.
